Introduction
ID Mentors through its Portal, accessible at www.purnima-valiathan.com, (“Portal”), offers a number of online courses in the area of instructional design, learning experience design and e-learning. The terms and conditions and Privacy Policies (“Terms”) applies to all the services offered by ID Mentors including but not limited to online self-paced learning modules, online assessments, blog articles, and white papers.
Your use/access of the Portal or registration for the Services offered (with or without payment/with or without subscription) through any means shall signify Your acceptance of the Terms and Your agreement to be legally bound by the same.
If You do not agree with the Terms, please do not use the Portal or avail the Services or products offered. Any access to our Services/Portal/products through registrations/subscription is non-transferable. Please read these Terms carefully before You use the Portal or the Services. By clicking “Agree and continue” to the Terms of use, You are confirming that You agree to be bound by these Terms.
General Terms and Conditions
- Definitions
ID Mentors is a partnership firm (Registration Number: Firm/West/2015/1223) incorporated under the Indian Partnership Act, 1932 and having its registered office at 703, 7th floor Tower 29, Lotus Boulevard, Sector-100, Gautam Buddha Nagar, NOIDA, Uttar Pradesh – 201304.
Content means any material content that is made available by ID Mentors on the Portal or otherwise.
Contract means the legally binding contract between You and ID Mentors.
Court means the Courts in the Union Territory of Delhi.
ID Mentors Online Service means any services provided through the Portal (www.purnima-valiathan.com), including but not limited to online self-paced learning modules, online assessments, blog articles and white papers.
Subscription Pack means a bundle of self-paced online courses that You choose to purchase. A Subscription Pack is defined by a one-off payment.
General Terms and Conditions means the terms set out under this contract.
Order Confirmation means an order confirmation emailed to You in accordance with clause 2.2 of the Terms.
Payment Processor means the ID Mentors’ third-party payment gateway provider for ID Mentors’ products and services.
Pack means a Subscription Pack.
Subscription Pack means an annual subscription to access the ID Mentors’ portal that You choose to purchase, including all the self-paced online courses available on the portal currently and those that will be added from time to time. Please note that this DOES NOT include the 3 certification programs (Basic ID Certification; Intermediate ID Certification and Advanced ID Certification), which have to be purchased separately. Also note that the subscription doesn’t offer any virtual instructor-led training sessions or capstone projects/assignments.
Self-paced online course is packaged content, with explanations, videos, text, graphics, exercises, downloadable documents and templates that meet specific learning objectives.
We, Us, our means the firm, ID Mentors.
You means the person agreeing to these Terms.
Your Content means any content created, developed or in any way added on to the Portal by you or through Your password-protected account, such as part of an online course discussion, course reviews or comments. However, ID Mentors shall be the legal owner of all the content on the Portal.
- Contract Formation:
2.1 The pages of the Portal will guide You through the steps You need to follow to purchase a Pack. The order process allows You to check and amend any errors before submitting Your order.
2.2 Once the Payment Processor receives a legitimate payment for the Pack into its designated bank account, Your Order Confirmation will be emailed to You. When You receive Your Order Confirmation, You will be able to access the self-paced online courses on the ID Mentors portal.
2.3 The Order Confirmation confirms ID Mentors’ acceptance of Your order. The Contract will only be formed, and become legally binding, when the Order Confirmation is provided to You. If You have received a gift voucher to use for accessing a self-paced online course, the Contract will be formed and become legally binding when You redeem the voucher for the self-paced online course.
2.4 Persons who are competent and capable of contracting within the meaning of the Indian Contract Act, 1872 shall be eligible to register for the Portal and all the products or Services. Persons who are minors, etc. are not eligible to register on our Portal or for our Services. As a minor if You wish to use the Portal products or Services, such use shall be made available to You by Your legal guardian or parents, who has agreed to these Terms. In the event a minor utilizes the Portal/Website/Services, it is assumed that he/she has obtained the consent of the legal guardian or parents and such use is made available by the legal guardian or parents. ID Mentors will not be responsible for any consequence that arises as a result of misuse of any kind of the Portal or any of the products or Services that may occur by virtue of any person including a minor registering for the Services/products. By using the products or Services You warrant that all the data provided by You is accurate and complete and that the student using the Portal has obtained the consent of parent/legal guardian (in case of minors). ID Mentors reserves the right to terminate Your subscription and/or refuse to provide You with access to the products or Services if it is discovered that You are under the age of 18 (eighteen) years and the consent to use the products or Services is not made by Your parent/legal guardian or any information provided by You is inaccurate. You acknowledge that ID Mentors does not have the responsibility to ensure that You conform to the aforesaid eligibility criteria. It shall be Your sole responsibility to ensure that You meet the required qualification. Any persons under the age of 18 (eighteen) should seek the consent of their parents/legal guardians before providing any Information about themselves or their parents and other family members on the Portal.
- Payment Method
3.1 All prices for Pack offered on the Portal will be displayed during the order process. All prices quoted include applicable taxes and charges incurred by ID Mentors for use of debit or credit cards unless otherwise stated. You may incur additional charges for the use of debit or credit cards from Your provider and those charges are in addition to the advertised price.
3.2 Payment can be made by credit or debit card (or any other payment method permitted by ID Mentors portal such as gift vouchers) as explained in the order process. In all cases, ID Mentors treat payment as confirmation that You are the person authorised to use that credit card or debit card and that You are competent/capable of entering into the contract and place order for services/products offered by ID Mentors, and make payment for availing the services/products.
- The ID MENTORS’ Payment Processor
4.1 ID Mentors uses a Payment Processor to facilitate Your payments in respect of ID Mentors’ portal. To allow the Payment Processor to verify and process Your payments, it is necessary to provide certain personal information to the Payment Processor (including Your name, financial details, billing address and telephone number).
4.2 When You purchase a Pack, payments by credit or debit card are processed immediately via the Payment Processor over a secure link. No card details are held by ID Mentors.
4.3 Our Payment Processor will only use Your personal information for the purpose of processing payments and in accordance with the applicable data protection laws.
- ID Mentors Portal Service options
5.1 You can find a description of our ID Mentors portal Service options on the ID Mentors portal website, and it will show which ID Mentors portal Service options are available to You.
5.2 For Subscription Pack You automatically receive access to a set of self-paced online courses upon payment. The number of online courses You receive will be specified on the Subscription Pack page. It is NOT possible to ‘roll over’ online course access to the next year of Your subscription. You are responsible for completing all self-paced online courses within their expiry date (365 days from the date of payment). If You do not complete the self-paced online courses before their expiry date the amount that You paid for the Subscription Pack cannot be refunded.
- Your obligations when using ID Mentors portal
6.1 As the ID Mentors portal Service and the Content will be provided through a third party web browser (such as Microsoft Edge, Chrome or Firefox) You should also read the terms of use and privacy policy of the web browser. Under no circumstances, shall ID Mentors be responsible for the acts or omissions attributable to the web browser.
6.2 You are responsible for ensuring You have in place all hardware, software and telecommunications necessary to access and use the ID Mentors portal Service and will be responsible for all related charges, including the fees of internet service providers.
6.3 Your use of our Portal and/or Services is solely for Your personal and non-commercial use. Any use of the Portal, Services or products or their contents other than for personal purposes is prohibited. You agree not to:
(a) provide access of the Portal to any other individual or legal entity;
(b) disrupt, interfere with or restrict the use of the ID Mentors portal Service or the Content;
(c) use the ID Mentors portal Service in any way that prevents, disrupts or interferes with any other person’s use of the Services;
(d) abuse, harass, threaten, impersonate or intimidate any other users of the Services;
(e) upload or display any comments or materials through Your participation on the Portal which are false, offensive, sexually explicit, defamatory, threatening, obscene or unlawful or which infringe intellectual property rights or are violative of the applicable laws;
(f) probe, scan or test the vulnerability of the ID Mentors portal or attempt to circumvent or hack any user authentication or security controls in respect of the Portal;
(g) reverse compile, disassemble, reverse engineer, decompile, copy, duplicate, modify or adapt any software or other code or scripts forming part of the Portal (except to the extent permitted by law) or attempt to transmit to or via ID Mentors portal any information that contains a virus, worm, Trojan horse or other harmful or disruptive component;
(h) change, modify, delete, interfere with or misuse any files or other data created, owned or provided by the ID Mentors or any third party provided as part of the Portal; or
(i) use the Portal and/or Services in contravention of any applicable law.
6.4 When using the ID Mentors portal Service to access the Content, You promise and agree to:
(a) at all times behave with honesty, integrity and show courtesy, consideration and respect to others;
(b) respect the confidentiality of all information that You acquire in connection with the Portal.
6.5 At all times, the opinions and messages posted by users at the Portal do not reflect and are not representative of the views of ID Mentors or its employees, affiliates, suppliers or partners. ID Mentors is not responsible for the content of messages published by users to other users they have identified through ID Mentors portal and shall not be held liable for the same.
6.6 You will not (a) use this Portal and/or our Website and/or any of our product/s or Service/s for commercial purposes of any kind, or (b) advertise for money or sell the Portal or any product/s, Service/s or domain name/s or otherwise (whether or not for profit), or solicit others (including, without limitation, solicitations for contributions or donations) or use any public forum for commercial purposes of any kind, or (c) use the Portal and/or Website/our products and Services in any way that is unlawful, or harms ID Mentors or any other person or entity as determined by us.
6.7 No User shall be permitted to perform any of the following prohibited activities while availing our Services:

- Making available any content that is misleading, unlawful, harmful, threatening, abusive, tortuous, defamatory, libelous, vulgar, obscene, child-pornographic, lewd, lascivious, profane, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
- Stalking, intimidating and/or harassing another and/or inciting other to commit violence;
- Transmitting material that encourages anyone to commit a criminal offence, that results in civil liability or otherwise breaches any relevant laws, regulations or code of practice;
- Interfering with any other person’s use of, or learning from the Portal/Website/Services;
- Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner, committing any act that amounts to the infringement of intellectual property;
- Make available any content or material that You do not have a right to make available under any law or contractual or fiduciary relationship, unless You own or control the rights thereto or have received all necessary consents for such use of the content;
- Impersonate any person or entity, or falsely state or otherwise misrepresent Your affiliation with a person or entity;
- Post, transmit or make available any material that contains viruses, trojan horses, worms, spyware, time bombs, cancelbots, or other computer programming routines, code, files or such other programs that may harm the Portal/services, interests or rights of other users or limit the functionality of any computer software, hardware or telecommunications, or that may harvest or collect any data or personal information about other Users without their consent and of the employees/agents/associates of ID Mentors Portal;
- Access or use the Portal/Website/Services/products in any manner that could damage, disable, overburden or impair any of the Portal’s/Website’s servers or the networks connected to any of the servers on which the Portal/Website is hosted;
- Intentionally or unintentionally interfere with or disrupt the services or violate any applicable laws related to the access to or use of the Portal/Website/Services/products, violate any requirements, procedures, policies or regulations of networks connected to the Portal/Website/Services/products, or engage in any activity prohibited by these Terms;
- Disrupt or interfere with the security of, or otherwise cause harm to, the Portal/Website/Services/products, materials, systems resources, or gain unauthorized access to user accounts, passwords, servers or networks connected to or accessible through the Portal/Website/Services/products or any affiliated or linked sites;
- Interfere with, or inhibit any user from using and enjoying access to the Portal/Website/ Services/products, or other affiliated sites, or engage in disruptive attacks such as denial of service attack on the Portal/Website/Services/products;
- Use deep-links, page-scrape, robot, spider or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to increase traffic to the Portal/Website/Services/products, to access, acquire, copy or monitor any portion of the Portal/Website/Services/products, or in any way reproduce or circumvent the navigational structure or presentation of the Portal, or any content, to obtain or attempt to obtain any content, documents or information through any means not specifically made available through the Portal/ Website/Services/products;
- Alter or modify any part of the Services/Products;
- Use the Services for purposes that are not permitted by: (i) these Terms; and (ii) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdiction; or
- Violate any of the terms specified under the Terms for the use of the Portal/Website/Services/products.
- Technology limitations and modifications to ID Mentors portal
7.1 ID Mentors will use reasonable endeavours to make the Services available at the date and time agreed on Your Order Confirmation. However, certain technical difficulties, maintenance or testing, or updates required to reflect changes in relevant laws and regulatory requirements, may, from time to time, result in temporary interruptions. ID Mentors does not and cannot warrant or guarantee that Your use of ID Mentors portal will be uninterrupted or error-free. ID Mentors shall not be responsible for any delays, delivery failures, or any other loss or damage resulting from the transfer of data over communications networks and facilities, including the Internet, and You acknowledge that the ID Mentors portal Service may be subject to limitations, delays and other problems inherent in the use of such communications facilities.
7.2 ID Mentors may, from time to time, at its sole discretion and without prior notice to You, change, expand and improve the Portal and/or any and all Services. ID Mentors may also, at any time, cease operating part(s) or all of the Portal or selectively disable certain aspects or portions of the Portal and/or any Content. Any modifications or eliminations of the Service or the Content are at the sole and absolute discretion of ID Mentors, and Your use of the ID Mentors portal Service does not entitle You to the continued provision or availability of the Portal.
7.3 You understand, agree, and accept that ID Mentors will make reasonable efforts, although it has no obligation to maintain, support, upgrade, or update the Portal Service or Content, or to provide all or any specific content through the ID Mentors portal Service.
- Managing Your Subscription Pack
8.1 If You have selected a Subscription Pack, payment will be taken upon order of the Subscription Pack. Your payment to ID Mentors for any paid Subscription Pack will automatically continue, and Your access to the self-paced online courses in the Subscription Pack will automatically terminate at the end of the applicable subscription period.
8.2 You will receive a receipt of payment via email when you purchase a Subscription Pack.
8.3 ID Mentors may change the price for the paid Subscription Pack from time to time and will indicate the price changes to You on the Portal. Any changes in price will take effect when you renew your subscription after the end of Your current subscription period.
- Subscription Pack details
9.1 You can check Your Subscription Pack details by logging into Your ID Mentors portal account and by clicking on Your name in the top right-hand corner. You will see a drop-down menu with various options to choose from, including Courses.
- Cancellation of the Contract
10.1 This Contract will continue to apply to You until cancelled by either You or ID Mentors.
Cancellation by ID Mentors
10.2 ID Mentors may cancel this Contract or suspend Your access to the ID Mentors portal Service by giving You notice in writing (whether by email or otherwise) at any time if You breach these Terms, in which case ID Mentors shall have no liability or responsibility towards You or any person, and ID Mentors will not refund any amounts that You have already paid.
10.3 ID Mentors may also cancel the Contract or suspend Your access to the Portal Service at any time, and it will not be liable in case cancellation or suspension has taken place for the following reasons:
(a) ID Mentors is unable to provide the ID Mentors portal Service in full due to a reason beyond its control; or
(b) ID Mentors withdraws part of or the whole of the Portal Service and/or the Content (in which case You shall be provided a Notice, as soon as possible).
10.4 If ID Mentors cancels the Contract under Clause 10.3, You will be entitled to receive a full refund of the price paid at the time of cancellation. However, ID Mentors shall not be liable for any other amount.
- Data protection
11.1 We will only use Your personal information as set out in our privacy policy.
- Intellectual property
12.1 ID Mentors is the owner or the licensee of all intellectual property rights in the Content and in the design, structure, “look and feel” and the arrangement of our self-paced online courses and the ID Mentors portal. We grant You limited, non-exclusive, revocable permission to make use of the ID Mentors portal Service for the purposes of Your study and research, and limited, non-exclusive, revocable permission to make personal, non-commercial use of the Content for the purposes of Your study and research (collectively, “Access”). This Access shall remain in effect until and unless this Contract is cancelled by You or ID Mentors. You agree that You are using the ID Mentors portal Service and Content for Your own personal, non-commercial use and that You will not redistribute or transfer the ID Mentors portal Service or the Content.
12.2 You recognize and accept that all information, content, material, trademarks, services marks, trade names, and trade secrets including but not limited to the software, text, images, graphics, video, script and audio, contained in the Portal, Website, Services and products are proprietary property of ID Mentors (“Proprietary Information”). No Proprietary Information may be copied, downloaded, reproduced, modified, republished, uploaded, posted, transmitted or distributed in any way without obtaining prior written permission from ID Mentors and nothing on this Portal or Website or Services shall be or products deemed to confer a license of or any other right, interest or title to or in any of the intellectual property resides, but ID Mentors shall at all times retain full and complete title to the information, content or materials and all intellectual property rights inserted by ID Mentors on such medium. Certain contents on the Portal may belong to third parties. Such contents have been reproduced after taking prior consent from said party and all rights relating to such content will remain with such third party. Further, you recognize and acknowledge that the ownership of all trademarks, copyright, logos, service marks and other intellectual property owned by any third party shall continue to vest with such party and You are not permitted to use the same without the consent of the respective third party.
12.2 You must not use the Content or material contained in the ID Mentors portal Service, completely or as a part thereof, for any other purpose without our prior written approval, including but not limited to:
(a) for commercial purposes;
(b) republishing any of the Content on another website;
(c) modifying the Content in any way;
(d) using any illustrations, images, video or audio sequences or any graphics within ID Mentors Content separately from any accompanying text; and
(e) removing any trademark, copyright or other proprietary work contained in or appearing on ID Mentors portal or any of the Content in whole or in part.
12.3 If You wish to make any use of ID Mentors Content that is not authorized by these Terms, please contact us at info@purnima-valiathan.com for a written permission explaining the purpose of use and full details of any Content You wish to use.
12.4 With respect to the provision of information, the following may be noted:-
(a) It is Your sole responsibility to ensure that the account information provided by You is accurate, complete and latest.
(b) You shall be responsible for maintaining the confidentiality of the account information and for all activities that occur under Your account. You agree to (a) ensure that You successfully log out from Your account at the end of each session; and (b) immediately, and in any case not later than 6 hours from the time of occurrence of the unauthorized act, notify ID Mentors of any unauthorized use of Your account. If there is reason to believe that there is likely to be a breach of security or misuse of Your account, we may request You to change the password or we may suspend Your account without any liability to ID Mentors, for such period of time as we deem appropriate in the circumstances. We shall not be liable for any loss or damage arising from Your failure to comply with this provision.
(c) You acknowledge that Your ability to use Your account is dependent upon external factors such as internet service providers and internet network availability and ID Mentors cannot guarantee accessibility to the Portal at all times. In addition to the disclaimers set forth in the Terms, ID Mentors shall not be liable to You for any damages arising from Your inability to log into Your account and access the services of the Portal at any time.
- ID Mentors’ liability towards You
13.1ID Mentors does not accept any responsibility and expressly exclude liability for any loss or damage to Your property that occurs where the ID Mentors is delivering the ID Mentors portal Service.
13.2 ID Mentors shall not under any circumstances whatsoever be liable to You (whether for breach of contract, negligence, breach of statutory duty or otherwise) for any:
(a) losses that were not foreseeable to both You and ID Mentors when the Contract was formed;
(b) losses that were not caused by any breach on the part of ID Mentors; or
(c) loss of profit, loss of business, business interruption or loss of business opportunity arising under or in connection with the Contract.
13.3 ID Mentors’ liability in connection with the Contract will be limited to the price paid by You for the Subscription Pack purchased under the Contract.
13.4 ID Mentors shall have no responsibility for any loss or damage caused to tablet or any other hardware and/or software and/or instrument, including loss of data or effect on the processing speed, resulting from Your use of our Portal and Services.
13.5 In no event shall ID Mentor, its officers, directors, employees, partners or agents be liable to You or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits or any other claim arising out, of or in connection with, Your use of, or access to, the Portal and/or Services.
- Failure to comply with these Terms
14.1 If ID Mentors believes that You have not complied with these Terms, ID Mentors may:
(a) refuse Your further use of and/or access to ID Mentors portal; and/or
(b) delete Your account; and/or
(c) remove and/or edit any of Your Content from the platform.
14.2 In the event of Your breach of these Terms, You agree that ID Mentors will be irreparably harmed and may not have an adequate remedy in money or damages. ID Mentors therefore, shall be entitled in such event to obtain an injunction against such a breach from any court of competent jurisdiction. ID Mentors’ right to obtain such relief shall not limit its right to obtain other remedies including the right to claim damages.
14.3 Any violation by You of the Terms may result in immediate suspension or termination of Your Accounts apart from any legal remedy that ID Mentors can avail. In such instances, ID Mentors may also disclose Your Account information if required by any Governmental or legal authority. You understand that the violation of these Terms could also result in civil or criminal liability under applicable laws.
- Other important terms
15.1 ID Mentors may transfer the Contract (in whole or in part), or subcontract or delegate the delivery of ID Mentors Portal Service in any manner at its sole discretion to: (i) any separate entity controlled by ID Mentors or otherwise forms a part of the ID Mentors group of entities; or (ii) any provider of outsourcing or third party services that is engaged under a service contract to provide services to ID Mentors.
15.2 The Contract is personal to You and so You CANNOT transfer any or all of Your rights or obligations under these Terms to another person without the prior written consent of ID Mentors.
15.3 These Terms constitute the entire Contract between You and ID Mentors in relation to ID Mentors portal and supersede any prior agreements in relation to the subject matter of the Contract, whether written or oral.
15.4 Please note, however, that certain aspects of Your use of the ID Mentors portal Service may be governed by additional terms. That could include, for example, a free or discounted Trial or a promotional subscription. When You are presented with such an offer by ID Mentors, we will provide You with any related additional terms, and You may have an opportunity to agree to additional terms. To the extent that there is any irreconcilable conflict between any additional terms and these Terms, the additional terms shall prevail.
15.5 If ID Mentors does not insist immediately that You do anything You are required to do under these Terms, or if ID Mentors delays in taking steps against You in respect of You breaching this Contract, that will not mean that You do not have to do those things and it will not prevent ID Mentors taking steps against You at a later date.
15.6 Each of the clauses of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining clauses will remain in full force and effect.
15.7 The laws of India apply to the Contract and any dispute or claim arising out of or in connection with the Contract or its subject matter or formation (including non-contractual disputes or claims). For the avoidance of doubt, this Contract is deemed to have been formed in India. Any dispute or claim arising out of or related to this Contract shall be brought in the courts of Delhi and You shall submit to the jurisdiction and venue of the Delhi courts.
15.8 ID Mentors hopes to make Your experience of dealing with the ID Mentors an excellent one and welcomes Your comments, suggestions and details of satisfaction or dissatisfaction. If You have any comments or complaints in relation to the Contract, please contact us at info@purnima-valiathan.com.
15.9 If a complaint, dispute or claim is not successfully resolved through discussions between You and ID Mentors, the courts of Delhi will have exclusive jurisdiction over any claim arising from, or related to, the Contract.
15.10 ID Mentors may contact You or provide a notice referred to in this Contract through the ID Mentors portal or by sending You an email to the nominated email address provided by You during the order process.
15.11 ID Mentors have the right to change, modify, suspend, or discontinue and/or eliminate any aspect(s), features or functionality of the Portal or the Services as it deems fit at any time without notice. Further, ID Mentors have the right to amend these Terms from time to time without prior notice to You. ID Mentors make no commitment, express or implied, to maintain or continue any aspect of the Portal or Services. You agree that ID Mentors shall not be liable to You or any third party for any modification, suspension or discontinuance of the Portal/Services. All prices are subject to change without notice.
15.12 In the preparation of the Portal/Website/Services/products and contents therein, every effort has been made to offer the most current, correct, and clearly expressed information possible. Nevertheless, inadvertent errors may occur. In particular, but without limiting anything here, ID Mentors disclaims any responsibility for any errors and accuracy of the information that may be contained on the Portal. Certain contents on the Portal/Services/Website/products may contain opinions and views. ID Mentors shall not be responsible for such opinions or any claims resulting from them. Further, ID Mentors makes no warranties or representations whatsoever regarding the quality, accuracy, completeness, or adequacy of such information and data.
15.13 Our Portal provides Users with access to compiled educational information and related sources. Such information is provided on an As Is basis and We assume no liability for the accuracy or completeness or use or non-obsolescence of such information. We shall not be liable to update or ensure continuity of such information contained on the Portal. We would not be responsible for any errors, which might appear in such information, which is compiled from third party sources or for any unavailability of such information. From time to time the Portal may also include links to other websites. These links are provided for Your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s). You may not create a link to the Portal from another website or document without the ID Mentors’ prior written consent.
